Welcome to drills.golf ("Platform"), operated by Good Company OÜ ("Company," "we," "us," or "our"), a company registered in Estonia with its registered office at Sepapaja 6, 15551, Harjuma, Tallinn, Estonia.

These Terms and Conditions ("Terms") govern your access to and use of our platform, services, applications, and website located at https://drills.golf (collectively, the "Service").

By using the Service, you agree to be bound by these Terms. If you do not agree, please do not access or use the Service.

1. Definitions

"Platform" refers to the website, applications, and related services provided by drills.golf.
"User" refers to any person accessing or using the Service, including Players, Coaches, and Team Players.
"Account" means a registered user profile created to access the Service.
"Content" refers to all data, text, images, videos, graphics, and other materials uploaded, submitted, or displayed on the Platform.

2. Eligibility

By using drills.golf, you confirm that:

You are at least 16 years old or have parental consent, or coaches consent, or your clubs, teams or organizations consent, if under 16.
You have the legal authority to enter into these Terms.
You comply with all applicable laws and regulations.

3. Account Registration

To use certain features, you must create an account.

Accurate Information: You agree to provide accurate, current, and complete information.
Account Security: You are responsible for maintaining the confidentiality of your login credentials.
Unauthorized Use: Notify us immediately at support@drills.golf if you suspect unauthorized access to your account.

4. Subscription Plans and Payments

A. Subscription Types:

Unlimited Plan: Paid by solo users (Players) or paid by Coaches, Clubs, Teams, or Organizations covering their team members.

B. Billing and Payments:

Payments are processed via secure third-party payment processors.
Subscription fees are billed on a monthly or annual basis, depending on your selection.
Auto-Renewal: Subscriptions renew automatically unless canceled before the renewal date.

C. Refund Policy:

No Refunds: All payments are non-refundable, except where required by law.
You may cancel your subscription at any time, and access will continue until the end of the billing cycle.

5. User Roles and Responsibilities

A. Players (Individual Users):

Manage their own practice schedules and data.
Responsible for maintaining the accuracy of personal records.

B. Coaches (Team Managers):

Oversee team members' activities, assign drills, and manage subscriptions.
Ensure compliance with these Terms by their team members.

C. Team Players (Part of a Coach's Team):

Follow coach-assigned schedules.
Limited control over personal settings as determined by the Coach, Club, Team, or Organization.

6. Acceptable Use Policy

You agree NOT to:

Violate any laws, regulations, or third-party rights.
Upload malicious code, viruses, or harmful software.
Use the Service for unauthorized commercial purposes.
Engage in abusive, harassing, or discriminatory behavior.
Attempt to reverse-engineer, decompile, or extract the source code of our Platform.
Engage in web scraping, data mining, or automated data collection without prior written consent.

We reserve the right to suspend or terminate accounts that violate this policy.

7. Intellectual Property

Ownership: All content, trademarks, logos, and software are owned by Good Company OÜ or its licensors.
License: We grant you a limited, non-exclusive, non-transferable license to use the Service for personal or team-related purposes.
Restrictions: You may not copy, modify, distribute, sell, or lease any part of our Service without prior written consent.

8. User-Generated Content

You retain ownership of the content you submit to drills.golf but grant us a worldwide, royalty-free, non-exclusive license to:

Use, display, and distribute your content to operate and improve the Service.
Share anonymized or aggregated data for analytical or marketing purposes.

You are solely responsible for the content you upload, ensuring it does not violate any laws or third-party rights.

9. Privacy

Your privacy is important to us. Please review our privacy policy to understand how we collect, use, and protect your data.

10. Service Availability

We strive to provide a reliable service but do not guarantee that the Platform will be uninterrupted, secure, or error-free.

Downtime: Scheduled maintenance or technical issues may cause temporary unavailability.
Modifications: We may modify, suspend, or discontinue any part of the Service at our discretion without prior notice.

11. Limitation of Liability

To the maximum extent permitted by law:

Good Company OÜ shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill.
Our total liability arising from these Terms shall not exceed the amount paid by you for the Service in the past 12 months.

12. Indemnification

You agree to indemnify and hold harmless Good Company OÜ, its affiliates, and employees from any claims, damages, losses, or expenses arising from:

Your use of the Service.
Violation of these Terms.
Infringement of third-party rights.

13. Termination

We reserve the right to suspend or terminate your access to the Service if you:

Violate these Terms.
Engage in fraudulent or illegal activities.
Cause harm to the Platform or other users.

Upon termination:

Your right to use the Service ceases immediately.
We may delete your data, subject to legal obligations.

14. Governing Law and Dispute Resolution

Governing Law: These Terms are governed by the laws of Estonia, without regard to conflict of laws principles.
Jurisdiction: Any disputes arising from these Terms shall be resolved in the courts of Tallinn, Estonia.

16. User Experience Systemic Emails

By signing up you agree to receive emails that are aimed at enhancing your user experience. These include but are not limited to "Daily Drill Reminders", "Empty Calendar Notification", and similar. You can opt out of this emails at any time by navigating to "Profile" > "Notifications".
